Design Partner Terms of Service & Liability Waiver

Version 2026-07-06-draft · Elephant Accountability LLC ("Knolled" / "Sales EDC" / "we")

Signing up with the "I agree" box checked records your acceptance of this version, with a timestamp, on your account.

1. It's a beta, provided as-is.

Sales EDC is early software. It is provided as-is, with no warranty of accuracy, reliability, or fitness for any purpose. Drafts and answers can be wrong. You are responsible for reviewing anything it produces before you rely on it or send it.

2. You approve every send — and you own what you approve.

No outbound message is ever sent without your explicit approval. Once you approve a message, you bear final responsibility for its content and its consequences, the same as if you had written and sent it yourself.

3. Liability cap.

To the fullest extent the law allows, our total liability to you for any claim arising out of the service is capped at the fees you paid us in the 3 months before the claim arose. We are not liable for indirect, incidental, or consequential damages — including lost profits, lost deals, or lost data.

4. Your data.

Your book lives in an isolated tenant; it is never shared across customers. Your raw inputs (contacts, emails, documents) are returnable to you in full on request, and your tenant is erasable on request — with a deletion receipt. We measure product usage (retention, actions taken, replies, outcomes); only aggregate metrics are ever used in our materials, and your name, company, or testimonial only with your prior written approval.

5. Not professional advice.

Nothing the service produces is legal, financial, tax, or other professional advice.

6. Your side of the data.

You confirm you have the right to connect the data you connect — your mailbox, your contacts, your book — and that connecting it does not violate any agreement you are under.

7. Term and cancellation.

The founding offer (the for-life founding price) requires staying subscribed for the first 3 months; after that, cancel anytime. Walking away is always your right — ending early just means the founding price isn't locked. On exit, section 4 applies in full: your raw data returned on request, your tenant erased on request, with a receipt.

8. Governing law.

These terms are governed by the laws of the State of California, USA.

9. Changes to these terms.

If these terms change, we will notify you by email before the change takes effect, with the version string bumped. Continued use after notice means you accept the new version; your account always records which version you agreed to, and when.
